Terms and Conditions of Sale

 

  1. General

 

  1. These terms and conditions of sale apply to the use of and the purchase of goods through the website at www.ggmm.co.uk (the “Website”)

 

  1. The Website is owned and operated by Symple Limited, Company Number 07334050 (“us”, “we” etc). Our registered office is 60 Rossendale Road, Earl Shilton, Leicester, LE9 7LX, United Kingdom.

  1. Contracting with Us

 

  1. When you place an order with us, you are making an offer to buy goods (iPad Cases or iPad accessories). We will send you an automated email to confirm that we have received your order. Once we have checked the price and availability of the goods, we will email you again to confirm that we have accepted your order and at that point a contract has been made between us. We take payment for the goods requested before we have accepted your order, but we do this for ease of administration and it should not be seen as the contract being formed at payment stage.

 

  1. In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. You will not receive an e-mail confirming acceptance of your order and there will be no contract between us. If you decide not to proceed with the purchase, you will be given a full refund.

 

  1. How to place an order

 

  1. Once you have selected the product(s) you wish to buy from the Website, you will be asked to create an account. You must provide us with personal data (which will be held in accordance with our Privacy Policy) which will include name, delivery address and payment billing address.

 

  1. You will be guided through several screens where you should input the relevant details. Once you have provided all the relevant information you can confirm your order. Doing this will take you to our payment gateway, whose secure systems will allow you to make payment for the goods you have requested. Payment will be taken immediately. However, a contract is only created once we have accepted your order and emailed you to confirm that your order has been accepted.

     

  2. If you make an input error prior to placing an order, you can go back to the previous screen and amend the relevant details. If you realise you have made an error in the details you have provided after you have paid, then please email sales@buyipadcases.co.uk or 0844 272 0913 as soon as possible and we will assist.

     

  3. If once you place your order we contact you to say that we do not have that item in stock or that the price has changed, you will be entitled to ask for a full refund of all charges without any question.

 

  1. Delivery

 

  1. We only deliver to the UK (which includes Wales, Scotland, Northern Ireland and even Swindon).

 

  1. We will usually deliver to the delivery address stated in your Paypal or Google Checkout account. If this differs from the account given for delivery when placing your order, please let us know by adding a comment to your order.

 

  1. We charge a flat rate delivery charge of £3.50 and will deliver all orders by Royal Mail First Class. We reserve the right to charge additional amounts for delivery if necessary and will hold back delivering items until we are placed in funds.

 

  1. Please contact us before placing an order if you require any other delivery methods, such as courier or Special Delivery. We are currently looking to build other delivery options into our website.

 

  1. Royal Mail “aims to deliver most First Class mail by the next working day, including Saturdays” although it could take up to 7 days for an item to be delivered. By placing an order you agree that we are not responsible for late delivery and that, unless specifically requested or advised, time of delivery is not of the essence of any contract between us.

 

  1. If goods are lost or damaged in transit, please advise us as soon as possible and in the case of damage, no more than 48 hours after receipt of such goods. We will make a claim against Royal Mail (or other applicable delivery company) in such circumstances and you agree not to hold us liable and await compensation from the Royal Mail/other company.

 

  1. We may, at our absolute discretion, consider a refund or return and exchange for goods damaged in transit.

 

  1. Cancellation and Returns

 

  1. You can cancel your order at any point before we email you to say your order has been shipped without any cost. Simply emailsales@buyipadcases.co.uk or call 0844 272 0913 quoting your reference number.

 

  1. You can return the goods and receive a full refund of the purchase price if you email sales@buyipadcases.co.uk or call 0844 272 0913 WITHIN SEVEN BUSINESS DAYS FROM THE DATE YOU RECEIVE THEM (the “7 Day Guarantee”)You do not need a reason to want to return the goods.

 

  1. If you want to return the goods under the 7 Day Guarantee, you are totally responsible for the cost of returning the goods to us. You are responsible for loss or damage to the goods and so we recommend that you return the goods by Royal Mail Recorded or Special Delivery.

 

  1. Any goods returned under the 7 Day Guarantee must be in saleable condition and in their original packaging. The cost of rectifying any damage to the goods or packaging will be deducted from any refund made.

 

  1. If you fail to return the goods to us within 10 business days, we will arrange for them to be collected by courier and you will be liable for those collection costs.

 

  1. We will refund the purchase price in full within 10 business days of our receipt of the goods, subject to clause 5.4.

 

  1. This cancellation policy does not affect your statutory rights.

 

 

  1. Electronic Communication

 

  1. When you visit the Website or send emails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

 

  1. Losses

 

  1. We will not be responsible for any loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of goods by us to you was formed, if we breach any terms of the contract between us.We do not limit in any way our liability in law for death or personal injury caused from our negligence or breach of duty or caused by our gross negligence or wilful misconduct.

 

  1. Alterations to these terms

 

  1. We may make changes to these terms and conditions at any time. You will only be subject to the terms and conditions presented to you at the time of each purchase.

 

  1. Governing law and jurisdiction

 

  1. These conditions are governed by English Law.

 

  1. Entire agreement

    1. These terms and conditions govern our relationship with you. You confirm that, in agreeing to accept these terms and conditions,you have not relied on any representation unless a representation has expressly been made a term of the contract between usand you agree that you shall have no remedy in respect of any representation. Your statutory rights are not affected by these terms and conditions. Nothing in this clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.
